“Mark”
includes a device, brand, heading, label, ticket, name, signature, word,
letter or numeral or any combination thereof.
“Trade Mark” means a mark used or proposed to be used in
relation to goods for the purpose of indicating or so as to indicate
a connection in the course of trade between the goods and some person
having the right, either as proprietor or as registered user, to use
the mark whether with or without any indication of the identity of that
person.

one enterprises from those of others. The value of Trademark in modern
economic is enormous. Some of the Trademarks of well known brands may
cost millions of dollars while other may not face such a value. “Trademark”
apart from specifying the trade origin of the goods now a days specify
the quality rather ensures warranty of quality. Particular goods bearing
a particular brand has a specific quality while the same goods bearing
another Trademark may have a lesser or a higher quality.
There
are concerns, challenges and opportunities on the country’s economy
in terms of developing specific multilateral rules in industrial property
and overcoming from the treat of unilateralism. Nevertheless, the TRIPS
Agreement has laid down several opportunities, in particular for least
developed countries like Myanmar (Burma), to derive benefit out of those.
The Agreement has offered protection for the developing countries against
unilateral pressure in international trade in industrial properties.
The Agreement has provided with the availability of technical assistance
and technical co-operation from the developed countries in its implementation
and in institutions building, transfers of technology and other joint
venture arrangements.
Myanmar (Burma) is quite conscious of its obligation towards world community
for promotion, protection and maximizing Intellectual Property System
in conformity with the TRIPS agreement and other relevant international
laws. However, several concern and challenges are being strategically
considered by Myanmar (Burma) to minimize their adverse effects on its
implementation, while at the same time alternative strategy is being
formulated to maximize the gain from the opportunities.
